NOTICE OF PUBLIC HEARING ON PROPOSED DRAWINGS AND SPECIFICATIONS, PROPOSED FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF PROPOSED WATER MAIN IMPROVEMENTS - DES MOINES RIVER CROSSING AT VINE STREET - FEMA #DR-4421 PW 962 - OTTUMWA WATER & HYDRO, OTTUMWA, IA - 2021
Notice is hereby given that Ottumwa Water & Hydro (hereafter called “OWNER”) whose principal office is in the city of Ottumwa, Iowa, will meet in the office of the General Manager at Ottumwa Water & Hydro, 230 Turner Drive, in said City, on the 14th day of October 2021, at 1:00 p.m., at which time and place a hearing will be held on the proposed DRAWINGS AND GENERAL SPECIFICATIONS, form of CONTRACT and ESTIMATE of COST for the Proposed Water Main Improvements - Des Moines River Crossing at Vine Street – Ottumwa Water & Hydro, Ottumwa, Iowa - 2021. Any interested party may appear to be heard.
The extent of the WORK involved consists generally of the following items and approximate quantities: 1,400 L.F. of 12” water main, trenchless, DR9 HDPE; 24” steel conductor casing; 20 L.F. of 12” water main, trenched, DIP-RJ; 60 L.F. of 10” water main, trenched, DIP-RJ; 1,500 lbs. of ductile iron fittings; 2 - 10” x 10” tapping sleeve, gate valve and box; 2 - main tie-ins; air release valve and pit; 180 S.Y. of pavement removal and replacement; and miscellaneous appurtenant work usually associated with a water main improvement project.
The work will be located generally across the Des Moines River at Vine Street in Ottumwa, Iowa.
A pre-bid conference will be held at 2:00 p.m. local time on October 5, 2021, at 505 Gateway Drive, Ottumwa, IA. Attendance at the pre-bid conference is a mandatory prerequisite for all prime contractors submitting a bid.
Sealed BIDS for the work comprising each improvement as stated above must be filed before 1:00 p.m., on October 14, 2021, in the office of the General Manager, Ottumwa Water & Hydro, 230 Turner Drive, Ottumwa, Iowa. Bids received after the deadline for submission of bids as stated herein shall not be considered and shall be returned to the late bidder unopened.
Sealed BIDS will be opened and tabulated at 1:00 p.m., on October 14, 2021, in the office of the General Manager of Ottumwa Water & Hydro, 230 Turner Drive, Ottumwa, Iowa. The BIDS will be considered by the Board of Trustees during their meeting beginning at 4:00 p.m. on October 19, 2021, in the office of the General Manager or at such later time and place as may then be fixed.
All WORK and materials are to be in compliance with DRAWINGS AND SPECIFICATIONS prepared by Brierley Associates, Cottage Grove, Minnesota, and French-Reneker-Associates, Inc., of Fairfield, Iowa, which, together with the proposed form of CONTRACT and estimate of cost have heretofore been approved by the OWNER and are now on file for public examination in the office of the General Manager and are by this reference made a part hereof as though fully set out and incorporated herein.
At the hearing, the OWNER will receive and consider any objections made by any interested person to the DRAWINGS AND SPECIFICATIONS, proposed form of CONTRACT, and the ESTIMATE of COST for the WORK prepared by the OWNER’S Engineer.
Bids will be received for a single prime Contract. Bids shall be on lump sum and unit price basis as indicated in the Bid Form.
All bids must be filed in said office before the time herein set, on forms furnished by the OWNER, and must be enclosed in a separate sealed envelope and plainly identified. Each bid shall be accompanied by bid security as defined in Iowa Code Section 26.8, in the form of a bid bond, certified check, cashier's check, or certified credit union share draft in a separate sealed envelope in an amount equal to five percent (5%) of the total amount of the bid. If a bid bond is submitted, it must be on the form provided with the contract documents. The certified check or cashier's check shall be drawn on a bank in Iowa, a bank chartered under the laws of the United States of America, or a certified share draft shall be drawn on a credit union in Iowa or chartered under the laws of the United States and payable to the Treasurer of the OWNER as security that if awarded a contract, the bidder will enter into a contract at the prices bid and furnish the required performance and payment bonds and Certificate of Insurance. The certified check, cashier's check, or certified share draft may be cashed, or the bid bond forfeited, and the proceeds retained as liquidated damages if the bidder fails to execute a contract or file acceptable performance and payment bonds or provide an acceptable Certificate of Insurance within fifteen (15) days after the acceptance of said BID by resolution of the OWNER. No bidder may withdraw a bid within ninety (90) days after the date set for opening bids.
Iowa sales tax will not be paid on materials purchased for this project. The OWNER will issue a sales tax exemption certificate.
Payment of the said WORK will be made in cash. Payment will be made in monthly estimates and one final payment. Payment for the WORK completed during the preceding calendar month will be determined by the Engineer pursuant to the GENERAL CONDITIONS and in accordance with the provisions of Chapter 573 Code of Iowa. Upon acceptance by the OWNER, the final payment will be issued on the balance found to be due the CONTRACTOR, including the retained percentages, but except such sums as may be lawfully retained by the OWNER, and shall be paid to the CONTRACTOR no earlier than thirty (30) days after the OWNER 'S Final Acceptance of the WORK.
The work under the proposed Contract shall commence on or before the date specified in the written Notice to Proceed. The Proposed Water Main Improvements - Des Moines River Crossing at Vine Street – Ottumwa Water & Hydro, Ottumwa, Iowa - 2021, shall be fully completed by June 1, 2022. The Bidder agrees to pay as liquidated damages the sum of $500 for each consecutive calendar day beyond the calendar day limit that the project is not fully completed.
To the extent allowed by Federal law and regulation, including but not limited to 2 C.F.R. §200.319, and by virtue of statutory authority, preference will be given to products and provisions grown and coal produced within the State of Iowa and to Iowa domestic labor to the extent lawfully required under Iowa Statutes.
To the extent allowed by Federal law and regulation, including but not limited to 2 C.F.R. §200.319, and to the extent required by Iowa law, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference allowed shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.
Failure to submit a fully completed Bidder Status Form with the Proposal may result in the Proposal being deemed nonresponsive and rejected.
Contract Documents. Drawings and specifications governing the construction of the proposed improvements have been prepared by Brierly Associates, Cottage Grove, MN, and French-Reneker-Associates, Inc., Engineers and Surveyors, Fairfield, Iowa. Each successful Bidder will be required to furnish Performance and Payment Bonds acceptable to the OWNER on forms provided in the specifications in amounts equal to one hundred percent (100%) of the contract price.
